Terms of Service

1. Introduction

These Terms of Service ("Terms") govern your use of the SevisPNG ecosystem, including SevisWallet, SevisPass, SevisPay, SevisDEx, and related services ("Services"). By accessing or using the Services, you agree to be bound by these Terms.

The Services are operated by the Department of Information and Communications Technology ("DICT") on behalf of the Government of Papua New Guinea.

2. Eligibility

To use the Services, you must:

• Be at least 18 years of age, or have parental/guardian consent if younger
• Be a citizen or legal resident of Papua New Guinea, or an authorized visitor
• Have the legal capacity to enter into a binding agreement
• Not be prohibited from using the Services under applicable law

3. Account Registration

When you create a SevisWallet account:

• You must provide accurate and complete information
• You are responsible for maintaining the confidentiality of your credentials
• You must notify us immediately of any unauthorized access
• You may not transfer your account to another person
• One person may only have one SevisPass credential

4. Acceptable Use

You agree to use the Services only for lawful purposes and in accordance with these Terms. You agree not to:

• Provide false, misleading, or fraudulent information
• Impersonate another person or create multiple accounts
• Use the Services to facilitate illegal activities
• Attempt to circumvent security measures or access controls
• Interfere with the proper functioning of the Services
• Reverse engineer, decompile, or disassemble the Services
• Use automated systems to access the Services without authorization

5. SevisPass Credentials

Your SevisPass is a verifiable credential that represents your digital identity:

• You are responsible for the accuracy of information in your SevisPass
• You must report any errors or unauthorized changes immediately
• SevisPass credentials may be revoked for violation of these Terms
• Different identity tiers have different verification requirements
• Relying Parties may require specific tier levels for their services

6. SevisPay Transactions

When using SevisPay for payments:

• You authorize all transactions initiated from your wallet
• Transactions are final once confirmed; reversals may not be possible
• You are responsible for ensuring correct recipient information
• Transaction limits may apply based on your identity tier
• Fees may apply as disclosed at the time of transaction
• Suspicious transactions may be held for review

7. Data and Privacy

Your privacy is important to us. Our collection and use of personal data is governed by our Privacy Policy. By using the Services, you consent to:

• Collection of personal information as described in the Privacy Policy
• Processing of biometric data for identity verification
• Sharing of data with Relying Parties when you provide consent
• Use of data for service improvement and security purposes

8. Intellectual Property

The Services, including all content, features, and functionality, are owned by DICT and the Government of Papua New Guinea. You may not:

• Copy, modify, or distribute the Services without authorization
• Use the SevisPNG name, logo, or branding without permission
• Remove or alter any proprietary notices

9. Disclaimers

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. TO THE FULLEST EXTENT PERMITTED BY LAW, DICT DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not guarantee that the Services will be uninterrupted, secure, or error-free. You use the Services at your own risk.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, DICT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, OR UNAUTHORIZED ACCESS TO YOUR ACCOUNT.

11. Termination

We may suspend or terminate your access to the Services at any time for:

• Violation of these Terms
• Fraudulent or illegal activity
• At the request of law enforcement
• Extended periods of inactivity
• Technical or security reasons

You may terminate your account at any time by contacting support. Upon termination, your credentials will be revoked and data handled per the Privacy Policy.

12. Governing Law

These Terms are governed by the laws of Papua New Guinea, including:

• The Constitution of Papua New Guinea
• Digital Government Act 2022
• National Data Governance & Data Protection Policy 2024

Any disputes shall be resolved in the courts of Papua New Guinea.

13. Changes to Terms

We may update these Terms from time to time. Material changes will be notified through the Services or by email. Continued use of the Services after changes constitutes acceptance of the updated Terms.
